1. PARTES / PARTIES
PT: De um lado, SunRoute Rentals LLC, com endereço em 5293 South Orange Blossom Trail, Orlando, FL 32839, EUA, doravante denominada LOCADORA, operando sob o nome fantasia FamilyGO; e, de outro lado, a pessoa identificada no resumo acima, doravante denominada LOCATÁRIO(A), celebram o presente Contrato de Locação de Veículo, que se regerá pelas cláusulas abaixo.
EN: On one side, SunRoute Rentals LLC, located at 5293 South Orange Blossom Trail, Orlando, FL 32839, USA, hereinafter the COMPANY, operating under the trade name FamilyGO; and, on the other side, the person identified in the summary above, hereinafter the RENTER, enter into this Vehicle Rental Agreement, governed by the clauses below.
2. OBJETO / SUBJECT
PT: A LOCADORA entrega ao LOCATÁRIO, em regime de locação, o veículo descrito no resumo acima, pelo período contratado, para uso pessoal e familiar, nas condições registradas na vistoria de entrega.
EN: The COMPANY rents to the RENTER the vehicle described in the summary above, for the contracted period, for personal and family use, in the condition recorded at the delivery inspection.
3. VALOR, PAGAMENTO E GARANTIA / PRICE, PAYMENT AND SECURITY HOLD
PT: O valor da locação será informado pela equipe FamilyGO e finalizado antes da entrega do veículo, incluindo eventuais taxas, impostos e extras opcionais. O LOCATÁRIO autoriza a LOCADORA a realizar uma pré-autorização de US$ 2,000.00 (dois mil dólares) no cartão de crédito informado, a título de garantia. Essa garantia poderá ser utilizada para cobrir: danos e avarias ao veículo, multas de trânsito, pedágios, diárias excedentes, combustível não reposto, limpeza excessiva, taxas administrativas e quaisquer outros valores devidos pelo LOCATÁRIO neste contrato. O saldo não utilizado será liberado conforme os prazos da operadora do cartão.
EN: The rental price will be quoted by the FamilyGO team and finalized before vehicle delivery, including any taxes, fees and optional extras. The RENTER authorizes the COMPANY to place a US$ 2,000.00 (two thousand dollars) pre-authorization hold on the credit card provided, as a security deposit. This hold may be used to cover: vehicle damage, traffic fines, tolls, extra days, unreplaced fuel, excessive cleaning, administrative fees and any other amounts owed by the RENTER under this agreement. Any unused balance will be released according to the card issuer's timelines.
4. RESPONSABILIDADES DO LOCATÁRIO / RENTER'S RESPONSIBILITIES
PT: Durante todo o período da locação, a responsabilidade integral pelo veículo é do LOCATÁRIO, incluindo, mas não se limitando a: guarda e conservação do veículo; multas e infrações de trânsito; pedágios; danos, avarias, furto ou roubo do veículo; e quaisquer prejuízos causados a terceiros. O LOCATÁRIO declara ter 21 (vinte e um) anos ou mais, possuir carteira de habilitação válida e, se estrangeiro, passaporte válido. É vedado: permitir condutores não autorizados por escrito; sublocar ou ceder o veículo; utilizá-lo para transporte remunerado de passageiros ou bens, competições, testes, reboque, fora de estrada (off-road) ou qualquer atividade ilícita; e conduzir sob efeito de álcool ou drogas. A circulação é restrita ao território dos Estados Unidos da América.
EN: Throughout the rental period, the RENTER bears full responsibility for the vehicle, including but not limited to: custody and care of the vehicle; traffic fines and violations; tolls; damage, theft or robbery of the vehicle; and any harm caused to third parties. The RENTER declares being 21 (twenty-one) years of age or older, holding a valid driver's license and, if a foreign national, a valid passport. It is forbidden to: allow drivers not authorized in writing; sublease or transfer the vehicle; use it for paid passenger or goods transport, racing, testing, towing, off-road driving or any unlawful activity; and drive under the influence of alcohol or drugs. Use is restricted to the territory of the United States of America.
5. ISENÇÃO DE RESPONSABILIDADE DA LOCADORA / COMPANY LIABILITY WAIVER
PT: Na máxima extensão permitida por lei, a LOCADORA fica isenta de qualquer responsabilidade por acidentes, lesões corporais, morte, danos materiais ou morais sofridos pelo LOCATÁRIO, passageiros ou terceiros em decorrência do uso do veículo, bem como por perda, furto ou dano a bens pessoais deixados no veículo. Toda a responsabilidade civil decorrente da posse e do uso do veículo durante a locação é exclusiva do LOCATÁRIO.
EN: To the maximum extent permitted by law, the COMPANY is exempt from any liability for accidents, bodily injury, death, property or moral damages suffered by the RENTER, passengers or third parties arising from the use of the vehicle, as well as for loss, theft or damage to personal belongings left in the vehicle. All civil liability arising from possession and use of the vehicle during the rental rests solely with the RENTER.
6. SEGURO / INSURANCE
PT: O LOCATÁRIO é responsável por possuir e manter cobertura de seguro adequada e suficiente durante todo o período da locação, incluindo responsabilidade civil contra terceiros, arcando com franquias e valores não cobertos.
EN: The RENTER is responsible for holding and maintaining adequate insurance coverage throughout the rental period, including third-party liability, bearing any deductibles and uncovered amounts.
7. ENTREGA E DEVOLUÇÃO / DELIVERY AND RETURN
PT: O veículo será entregue e devolvido mediante vistoria registrada por ambas as partes. O LOCATÁRIO deverá devolvê-lo no local, data e horário combinados, no mesmo estado de conservação e com o mesmo nível de combustível da entrega. Atrasos na devolução implicam cobrança de diárias adicionais e demais custos. Limpeza excessiva ou odores (ex.: cigarro) poderão gerar taxa de higienização.
EN: The vehicle will be delivered and returned subject to an inspection recorded by both parties. The RENTER must return it at the agreed place, date and time, in the same condition and with the same fuel level as delivered. Late returns will incur additional daily charges and related costs. Excessive cleaning needs or odors (e.g., smoke) may incur a detailing fee.
8. MULTAS, PEDÁGIOS E INFRAÇÕES / FINES, TOLLS AND VIOLATIONS
PT: Todas as multas, infrações e pedágios incorridos durante a locação são de responsabilidade do LOCATÁRIO e poderão ser cobrados do cartão de garantia, acrescidos dos custos administrativos incorridos pela LOCADORA.
EN: All fines, violations and tolls incurred during the rental are the RENTER's responsibility and may be charged to the guarantee card, plus administrative costs incurred by the COMPANY.
9. RESCISÃO / TERMINATION
PT: O descumprimento de qualquer cláusula autoriza a LOCADORA a rescindir o contrato e retomar o veículo imediatamente, sem prejuízo da cobrança dos valores devidos. Em caso de sinistro, furto ou roubo, o LOCATÁRIO deverá comunicar imediatamente a LOCADORA e as autoridades competentes, registrando boletim de ocorrência.
EN: Breach of any clause entitles the COMPANY to terminate the agreement and repossess the vehicle immediately, without prejudice to collecting amounts owed. In case of accident, theft or robbery, the RENTER must immediately notify the COMPANY and the competent authorities, filing a police report.
10. ASSINATURA ELETRÔNICA / ELECTRONIC SIGNATURE
PT: As partes reconhecem que o clique no botão "OK" ao final deste contrato equivale à assinatura do presente instrumento, constituindo manifestação de vontade válida e eficaz, nos termos do ESIGN Act e do UETA do Estado da Flórida (EUA) e da MP nº 2.200-2/2001 e do Código Civil brasileiro. O aceite é registrado com data, hora, endereço IP e dados do pedido de reserva.
EN: The parties acknowledge that clicking the "OK" button at the end of this agreement constitutes signing of this instrument, as a valid expression of consent under the ESIGN Act and the Florida UETA (USA) and under Brazil's MP 2.200-2/2001 and Civil Code. Acceptance is logged with date, time, IP address and booking data.
11. LEI APLICÁVEL, FORO E EXECUÇÃO / GOVERNING LAW, JURISDICTION AND ENFORCEMENT
PT: Este contrato é regido pelas leis do Estado da Flórida, EUA, sendo eleito o foro exclusivo dos tribunais do Condado de Orange, Flórida, para dirimir quaisquer controvérsias. O LOCATÁRIO consente, desde já, que decisões judiciais ou valores devidos com base neste contrato possam ser submetidos à homologação e execução no Brasil, perante o Superior Tribunal de Justiça e demais órgãos competentes, nos termos da legislação brasileira. Este contrato é redigido em português e inglês, ambos os textos igualmente autênticos; em caso de divergência, prevalece a versão em inglês.
EN: This agreement is governed by the laws of the State of Florida, USA, with exclusive jurisdiction of the courts of Orange County, Florida, to resolve any disputes. The RENTER hereby consents that court decisions or amounts owed under this agreement may be submitted for homologation and enforcement in Brazil, before the Superior Court of Justice (STJ) and other competent bodies, under Brazilian law. This agreement is drafted in Portuguese and English, both texts equally authentic; in case of divergence, the English version prevails.
12. DISPOSIÇÕES GERAIS / GENERAL PROVISIONS
PT: Se qualquer cláusula for considerada inválida, as demais permanecem em vigor (divisibilidade). Este contrato representa o acordo integral entre as partes quanto à locação. A tolerância quanto ao descumprimento não constitui renúncia de direitos.
EN: If any clause is held invalid, the remaining clauses remain in force (severability). This agreement represents the entire understanding between the parties regarding the rental. Forbearance regarding any breach does not constitute waiver of rights.
